公司不幫我申請職災，該如何保障自己的權益 ?
小恩在工作中不慎受傷，但公司卻不幫他申請職災保險傷病給付
甚至在她住院休養期間，不支付她薪水。
這讓一向樂觀的她，崩潰大哭的來找棕葵
棕葵現身來解答
如果投保單位不願於申請書件中蓋章為被保險人辦理請領手續，
被保險人可以自行提出申請。
相關規定
1、投保單位應為所屬被保險人辦理請領保險給付。投保單位有歇業、解散等或其他情事，未能為被保險人提出申請時，被保險人得自行申請。
2、被保險人遭遇職業傷病不能工作，
以致未能取得原有薪資，正在治療中者（包括住院或門診治療期間），
自不能工作之第4日起至恢復工作前1日止，得請領職災傷病給付。
如何請領
被保險人如符合職災傷病給付請領規定，
得於5年請求權時效內填寫「勞工職業災害保險傷病給付申請書」，並檢具「傷病診斷證明書正本」及相關證明文件，經由投保單位蓋妥印章後寄送本局。
如投保單位不願於申請書件中蓋章證明者，得由被保險人自行檢送前開書件提出申請，並請於投保單位證明欄內闡述單位不願意蓋章之原因，以利進行後續查證事宜。

勞工遭遇職業傷病，可申請自付差額特殊材料費用補助，降低負擔！
勞工職業災害保險及保護法上路後
提供更多安心保障
被保險人因職業傷病及其引起之疾病，經全民健康保險特約醫院或診所醫師認定有醫療上需要使用自付差額特殊材料品項者，於先行墊付自付差額後，得向勞工保險局申請核退該差額費用！
➊持由投保單位填發的「職業傷病門診單」或「職業傷病住院申請書」，並繳驗全民健康保險卡及國民身分證或其他足以證明身分的文件。
➋前往全民健康保險特約醫院或診所診療。
➌經醫師認定必須選用全民健康保險法第45條第1項所定自付差額特殊材料品項者，得向勞保局申請核退該差額費用。

If the worker suffers occupational injury or disease, he or she may apply to the insurer(the Bureau of Labor Insurance) for the reimbursement of the amount of special materials and items difference to reduce the burden!
The “Labor Occupational Accident Insurance and Protection Act” came into effect on May 1, 2022. Provide more peace of mind.
If due to illness caused by occupational injuries and diseases the insured is identified as having medical needs by the physicians in the NHI hospital or clinic and such insured selects special materials and items, after paying the special materials and items difference in advance, he may apply to the insurer for the reimbursement of the amount of difference.
➊Hold an occupational injury or disease Clinic Visit Form or Hospitalization Application Form that filled out by the insured unit. And submit the Certificate of National Health Insurance and National Identity Card or other documents sufficient to prove the identity.
➋The insured person who suffers occupational injury or disease shall seek treatment from a contracted hospital or clinic of national health insurance.
➌If due to illness caused by occupational injuries and diseases the insured is identified as having medical needs by the physicians in the NHI hospital or clinic and such insured selects special materials and items specified in Paragraph 1 of Article 45 of the National Health Insurance Act(For example：Special material artificial hip joint), after paying the difference in advance, he may apply to the insurer for the reimbursement of the amount of difference.

粉葵提醒各位女性，若因傷病需切除子宮，
就算年逾45歲也可申請勞保的失能給付！
現行生殖器失能請領規定已無年齡限制，
依據勞保失能給付標準規定，
切除子宮符合「生殖器遺存缺損者」定義，
失能等級為第12等級，給付日數為100日。
若在加保有效期間因傷病割除子宮，
且於111年4月1日(含當日)以後診斷失能者，
得於5年請求時效內，
洽詢全民健康保險特約醫院開立失能診斷書寄至勞工保險局。

由職業工會加保的勞工，
如果轉換本業工作，應該要怎麼辦理加退保呢？
實際從事工作的無一定雇主或自營作業勞工，
應由所屬本業職業工會申報加保。
職業勞工如已轉換本業工作，
應洽原投保的職業工會辦理退保，
另洽轉業後工作所在地的本業職業工會辦理入會加保，
以保障自身權益！
