家人在工作中失蹤，可否請領失蹤給付？

勞工職業災害保險及保護法施行後，不限於漁業生產勞動者或航空、航海員工或坑內工，被保險人如於「作業中遭遇意外事故致失蹤」時，自失蹤之日起，按被保險人失蹤當月起前6個月平均月投保薪資之70%發給失蹤給付。

於每滿3個月之期末給付一次，至生還之前一日、失蹤滿一年之前一日或受死亡宣告裁判確定死亡時之前一日止。

申請時記得檢具災難報告書或失蹤人口緊急報案紀錄、警消搜救紀錄、執行職務發生意外事故證明等資料佐證。

If a family member goes missing at work, is it possible to apply for disappearance benefits of labor occupational accident insurance?

Once the Labor Occupational Accident Insurance and Protection Act was implemented, missing persons are no longer limited to those who work in the fishing industry, aviation, naval vessels, or mines. If the insured person “suffers an accident and goes missing”, which happened on work ,the beneficiary can claim the benefit, which standard is based on 70% of the insured's average monthly insured salary will be given to the disappearance benefit since the date of disappearance.

The benefit shall be paid at the end of every 3-month period until the day before the missing person is found alive, the day before the person has been missing for one year, or the day before the missing person is declared dead by judgment.

Remember to file an accident report, or emergency report of missing person, police or fire agency rescue records, or other relevant accident certificates and certificate of accident in the execution of duties.
