「勞退新制」與「勞保老年給付」是兩種不一樣的制度，

依照勞工退休金條例規定，只要是適用勞基法的勞工

（含本國籍、外籍配偶、陸港澳地區配偶、永久居留的外籍人士），

就是勞退新制的強制提繳對象，無論是否已經領過勞保老年給付，

雇主即應依法提繳不低於其每月工資 6％的勞工退休金，

儲存於勞保局設立的勞工退休金個人專戶。

等勞工年滿60歲時

（或喪失工作能力符合勞工退休金條例第 24 條之 2 規定），

就可以向勞保局請領勞工退休金個人專戶內的本金及累積收益。

#勞退

The New Labor Pension System and the Old-Age Benefits are different social security schemes and make double protection. According to Labor Pension Act, as long as the laborer (including citizens; foreign spouses; spouses from mainland, Hong Kong, or Macau; and permanent resident foreigners) could apply to Labor Standards Act, even though the labor has retired and claimed old-age benefits, the employer should contribute 6% (or more) of a laborer's monthly wages into an individual labor pension account managed by the Bureau of Labor Insurance. Once laborer reaches the age of 60 or loses ability to work (meet the article 24-2 of Labor Pension Act), the laborer may apply to the BLI to claim the principal and accrued dividends from individual labor pension account.
